The Legalese of the California Variety of the “Alphabet Soup”

The California Disabled Veteran Business Enterprise and Small Business Program
Disabled Veteran Business Enterprise (DVBE) and Small Business (SB) Certification Programs were established to increase business opportunities for the DVBE and SB communities with the State of California; thereby stimulating the State’s overall economy. The programs are designed to help DVBEs and SBs participate on a more level playing field with certain advantages when competing against other non-DVBEs and non-SBs for State contracts and purchases.

DVBE certification entitles the certified business to participate in the State’s DVBE Participation Program, which establishes a goal of at least 3% of total overall annual State contracting dollars to be awarded to DVBE’s. Comparatively, SBs participation goal is set at 25%. SB certification also entitles the certified business to a five percent (5%) bid preference on applicable State contracts and procurements.

Providing all eligibility and compliance requirements are met, it is possible for a business to be certified as both SB and DVBE. Businesses that have this dual certification are able to experience the benefits of both certifications. (Supply Patriot is both DVBE and SB certified)

As an incentive, a non-SB prime contractor who uses certified SB subcontractors for at least 25% of its net bid price is eligible for a bid preference of five percent (5%) of the lowest possible bid when competing against another non-SB.

The Good Faith Effort (GFE) provision no longer applies to State contracts with a DVBE participation goal. If a solicitation contains a DVBE participation goal, then the awarding department must award the contract to the lowest responsible bidder who meets the goal.

The Department of General Services (DGS) established a DVBE incentive pursuant to Senate Bill 115 chaptered October 3, 2005 and the Military and Veterans Code section 999.5(a). The new regulations apply to all competitive solicitations for public works, services, goods, and information technology goods and services posted or released after October 9, 2007. The DVBE incentive is required in solicitations that include DVBE program requirements and may be offered in other competitive solicitations.

Every year, each State agency must submit to the legislature an annual report that tracks contract award activity involving DVBEs and SBs. The report must demonstrate that the various participation goals have been met or exceeded. If the minimum goals are not met, the agency must provide a sound justification and the remedial action they will take to attain or exceed the goal(s) the following year.
